CNN aired a report on Television at midday today, July 27th  which has me quite disturbed about the many directions the immigration issues in America are taking. We all know about the SB1070 law in Arizona which tries to identify the illegal immigrants within the  state of Arizona and detain and deport these individuals and their families, as a result. I am not aware that the Police, in the course of their duties while determining the status of the alleged person, is prohibited from also arresting the person’s spouse and children. In other words the law by not determining the boundaries of the Police’s authority, is in fact leaving room to allow arrests of the whole family, innocent American born children included.

The Arizona Law says there should be a reasonable amount of suspicion and a resulting reasonable attempt to establish the status of the suspect. I think this law is unreasonable to begin with, so my question is if the law is unreasonable does that negate the law itself. The law rests on reason instead of facts and laws, and it shapes the response by the Police in their duties and I ask if this is in fact enforceable by authorities on the Police themselves to force them to detain illegal persons. Could a Policeman be allowed to release someone who is illegal because the officer has used his reasoning to determine that the illegal person has legal children in the US and arresting this person would destroy the family unit, or some other reason the Policeman has determined warrants the release of the person. We shall see what develops on that issue as the hearings are starting soon.

My article today does not address that issue although I touched on it a bit but in fact draws attention to the fact that Illegal Immigrants who have gone to ICE and made their illegal status known, are being told that they cannot leave, after voicing their wishes to do just that. The CNN  Television  report sited an Ecuadorian family who brought their sick daughter to the US to have medical work done. The I94 issued to them was stamped with a date of six months and when it expired they were forced to stay illegally as the medical issues and treatment were ongoing and necessary. The family went on to have a second child in the US who is automatically deemed to be a US citizen by birth. The family now wishes to leave if they are not issued legal status. They are stuck in limbo.

The problem arose when the family inquired from various sources and found out the problems they face when trying to leave the US including heavy fines and possible detention and imprisonment. The CNN report also showed other persons who went to ICE and after making their status known to the authorities along with their request to be allowed to leave, at their expense, were told that they could not and will be detained if they attempted to leave. I am very surprised by this information and will surely follow up this development, you can be sure.

    This issue is developing several different opinion just within liberal or progressive groups. I think basic human rights is the most powerful element to be concerned in this issue. A point I’ve always just kinda thought that America upheld. Apparently not. (ok, coups and CIA and all that jazz… I get it.. still;) I’ve always thought of Americans as more concerned collectively with basic human rights. Tee, do you think I’m fooled? Or wrong? I wish I honestly knew how off or on I am…

      Gwen you are 100% dead on by thinking that America stands for justice and basic human rights. It is just the fringe elements in the Repuglicker party that are racist and hateful. THEY ARE THE SMALL GROUP THAT IS MAKING A MESS OF THIS ISSUE. You are correct…and me along with you!!

    There in lies the problem. There are so many situations that fall through the cracks of our immigration laws. Personnaly I think it should be easy to get a work visa or make those illegals an above board part of society. I’d rather see them pay a small fine like a traffic ticket and get proper documentation. In doing so employers would have no motive for trying to pay substandard wages. There is a data base for SS cards and it’s easy to check with just a phone call.
    And I’d agree this is about basic human rights.

    Interesting to note that my Wa. driver’s license is not a valid ID in Az. for their purposes. Guess I won’t be going to AZ any time soon.

      You got that right Demeur, let them pay a fine and file backtaxes, they can be a vibrant source of income from taxes and sales for the US. They do pay sales tax on the products they buy. I refuse to believe the solution is to break up families.
      Oh yea, stay away from Arizona, lol!

    The Republicans have chosen long term damage for short-term gain, opting to demonize the fastest growing ethnic element with the highest birth rate. They could have chosen to woo a demographically significant group which is very socially conservative.

    Just when you think they couldn’t get any stupider they sink to new lows. It’s funny.

      I do like the idea that the Repuglickers are shooting themselves in the foot, but not at the expense and suffering of the undocumented. I’m from the Caribbean, and a lot of my friends and family have overstayed and are here out of status…I refuse to say illegally.
      Actually that is how they are listed by USCIS…out of status.
      To me the term “illegal immigrant” is a way to insult these great people who come here and help to build this great country.

      Saturday I got letters in the mail confirming that I had refused the overdraft offer since April 30, so I faxed those to the branch and they removed the charges.
