Republican Oklahoma State Representative, Rex Duncan, has introduced legislation to put on the November 2 ballot a question to amend the constitution of Oklahoma. The ballot question would ask voters whether they are for, or against, allowing state courts to use Sharia Law. If you are not familiar with Sharia Law, it is a backward looking, medieval Islamic religious code that, among other bad things, tends to treat women like livestock. On the whack-o meter, it’s up there with The Bible’s Leviticus.
Rep. Duncan is concerned that if this pre-emptive strike against the encroaching nightmare of the Islamification of Oklahoma’s court system isn’t tackled now, then Sharia Law will certainly usurp the Constitution of the United States, and Oklahoma’s, forcing every Oklahoma Sooners fan to fall to their knees and pray in the general direction of Mecca.
Those in the legal know are not in the least scared of Sharia Law being implemented in place of American Jurisprudence in the Choctaw County District Court, Oklahoma. For one thing, it’s against the law. The Constitution of the United States is the base-line document of our secular legal system. The Constitution says the states are free to enact their own laws as long as they do not conflict with federal law. If a ruling by a court conflicts with the Constitution of the United States, with all of its amendments, including the equal protection clause and the establishment clause, it won’t stand. This isn’t a law that is needed. It is like passing a law to outlaw the repeal of the The Constitution.
A note on international law: The Supreme Court of the USA has on occasion employed international law to aid in the interpretation of cases before it that touch and concern international issues, like the interpretation of international treaties and international commerce. Fear mongering claptrap is what that is Lawyer, and you point it out It is like passing a law to outlaw the repeal of the The Constitution. The Sharia law that operates in the UK is only allowed to operate to settle domestic disputes within the very silly Islamic rules of conduct within marriages and child custody cases. British law rules, regardless of what is said by anyone with an ax to grind. Sharia law tries to settle family problems without bringing in the heavy hammer that is civil law.
I think what I heard is that it has been used in a few Scottish venues, but always in the context of alternative dispute resolution.
P.S. – Fox News was so willing to make this big news they forgot to include anything that made any sense and it was just an ad for the big Tea Party thing in Oklahoma later this year.
Wow.I was able to actually stand 1:33 of that asshole before I had to stop it. Similar to the AZ immigration law, yet far stupider. Yeah, Oso, that video is a tough watch. At the end Hannity makes this wild leap from the issue of the Oklahoma law to a few Muslims in a large crowd boo-ing British soldiers. Irrelevant and deceitful.
