Newt Gingrich attacks judicial branch as “un-American” (Video)
Newton Leroy “Newt” Gingrich, GOP presidential hopeful, is a man so bloated with ideas that they tend to spew forth indiscriminately. A friend of mine describes Newt as a loose cannon, loaded, fuse lit and rolling around the deck about to blow the mast and anyone in the way to smithereens.
Newt’s latest wild idea is to abolish the judiciary, at least the parts he doesn’t like and deems “un-American.”
At a recent GOP debate Newt said that the judiciary has become “grotesquely dictatorial, far too powerful and … frankly arrogant in their misreading of the American people.” In particular Newt wants to put the 9th Circuit Court of Appeals out of business because it isn’t conservative enough for his taste.
“I taught a short course in this at the University of Georgia Law School,” said Newt, “and I testified in front of sitting justices at Georgetown Law School and I warned them, ‘You keep attacking the core base of the American exceptionalism, and you will find an uprising against you which will rebalance the judiciary.’ We have a balance of three branches — not a judicial dictatorship in this country. … I will be prepared to take on the judiciary if it in fact did not restrict itself in what it was doing.”
If the legislative branch doesn’t like something the judicial does, the legislative can make a law to change the court’s decision. If a bill crafted by the legislative branch, and signed into law by the executive is found unconstitutional by the high court, an amendment to the Constitution can be sought pursuant to the procedure outlined in the Constitution.
If by the some horrific mishap of mass electoral ignorance Newt Gingrich becomes our 44th president, my advice is to abandon ship and swim for it.
